Terms of Service - Signature Collection

1. Agreement to Terms

By accessing or using the Signature Collection website and services, you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access our services.

2. Description of Services

Signature Collection provides luxury villa rental services in Santa Teresa, Costa Rica, including but not limited to Casa Teresa and Grand Casa Teresa. We facilitate bookings, manage reservations, and provide property management services.

3. Booking and Reservation Terms

3.1 Booking Process

All bookings are subject to availability and confirmation by Signature Collection
You must be at least 18 years old to make a reservation
Bookings are confirmed only upon receipt of payment
We reserve the right to refuse or cancel any booking at our discretion

3.2 Payment Terms

A deposit is required to secure your reservation
Full payment is due according to the payment schedule provided at booking
All prices are in USD unless otherwise stated
Additional fees may apply for extra services or damages

3.3 Cancellation Policy

Cancellations must be made in writing
Refund eligibility depends on the cancellation date and terms agreed at booking
No-shows are subject to full charge
We recommend purchasing travel insurance

4. Guest Responsibilities

As a guest, you agree to:

Provide accurate and complete information during booking
Respect the property and follow all house rules
Not exceed the maximum number of guests specified
Not use the property for illegal activities or purposes
Report any damages or issues immediately
Comply with local laws and regulations
Leave the property in good condition

5. Property Rules and Restrictions

Smoking may be prohibited in certain areas or properties
Pets may not be allowed unless specifically authorized
Parties and events may require prior approval and additional fees
Quiet hours must be observed
Use of amenities is at your own risk

6. Liability and Indemnification

6.1 Limitation of Liability

To the maximum extent permitted by law, Signature Collection shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of our services.

6.2 Indemnification

You agree to indemnify and hold harmless Signature Collection, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising out of your use of our services or violation of these Terms.

7. Property Availability and Modifications

While we strive to ensure property availability, we reserve the right to modify, cancel, or substitute accommodations due to circumstances beyond our control, including but not limited to maintenance issues, natural disasters, or property damage. In such cases, we will make reasonable efforts to provide alternative accommodations or issue a refund.

8. Intellectual Property

All content on our website, including text, graphics, logos, images, and software, is the property of Signature Collection or its content suppliers and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

9. Prohibited Uses

You may not use our services:

For any unlawful purpose or to solicit others to perform unlawful acts
To violate any international, federal, provincial, or state regulations, rules, laws, or local ordinances
To infringe upon or violate our intellectual property rights or the intellectual property rights of others
To harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate
To submit false or misleading information
To upload or transmit viruses or any other type of malicious code

10. Dispute Resolution

Any disputes arising out of or relating to these Terms or our services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except where prohibited by law. The arbitration shall take place in Costa Rica.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Costa Rica, without regard to its conflict of law provisions.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of our services after such modifications constitutes acceptance of the updated Terms.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
